What Is EDPMS and Why Does It Matter for Indian Exporters?

EDPMS, the <a href="https://www.skydo.com/blog/understanding-edpms-full-form-and-its-essential-role-in-export-management">Export Data Processing and Monitoring System</a>, is an RBI-mandated platform that tracks export transactions, specifically physical goods via Customs Shipping Bills and IT/software exports via SOFTEX forms from the moment the document is filed until the payment is received and reconciled. It matters because Indian exporters are required to use it to report inward remittances against export invoices, which ensures foreign earnings are properly accounted for under the Foreign Exchange Management Act (FEMA).

Say a Bengaluru-based software agency raises a $5,000 invoice for a UK client. Once the payment arrives in India, the agency must match that remittance to the original invoice inside EDPMS. Until the match is confirmed, the entry stays open and flagged.

Who Is Responsible for EDPMS Reporting, You or Your Bank?

The exporter is responsible for EDPMS reconciliation. The Authorised Dealer (AD) bank's role is to upload the shipping bill or export invoice data into EDPMS when the transaction is reported. Closing the entry, by submitting the Bank Realisation Certificate (BRC) and matching it to the <a href="https://www.skydo.com/blog/compliance-guideline-for-inward-remittance">inward remittance</a>, is your obligation as the exporter.

Banks do send periodic reminders for open entries. They still cannot close one on your behalf without the required documentation from your side.

This applies equally to large exporters with finance teams and to solo freelancers or small digital agencies. Whoever raised the export invoice owns the reconciliation task.

What Are the Common EDPMS Non-Compliance Scenarios?

EDPMS non-compliance occurs when an export transaction is entered into the system but the corresponding payment receipt is never reconciled against it, leaving the entry permanently open. The 3 most common scenarios are late or missing BRC submission, a missing or delayed Foreign Inward Remittance Certificate (FIRC), and unreconciled shipping bills or service invoices.

What Penalties Apply for EDPMS Non-Compliance?

EDPMS non-compliance falls under the Foreign Exchange Management Act, 1999 (FEMA). The penalty for FEMA violations can be up to 3 times the amount involved in the contravention, or ₹2 lakh where the amount cannot be quantified, whichever is higher.

FEMA governs all <a href="https://www.skydo.com/blog/guide-for-tech-exporters-on-global-compliance">foreign exchange transactions in India</a>. Beyond the monetary penalty, the RBI or the Enforcement Directorate can issue show-cause notices and require compounding of the offence, which is a formal settlement process. In serious or repeated cases, they can pursue adjudication proceedings.

Compounding an offence with the RBI is possible, but it involves a formal application, legal fees and reputational exposure. Prevention is significantly cheaper.

Exporters also experience practical consequences before a formal penalty is imposed. These include:

The severity of the consequence typically scales with how long the entry has been open and whether you can demonstrate a genuine documentation gap versus deliberate non-reporting.

Does the Documentation Lag Create an EDPMS Non-Compliance Risk?

Yes. Documentation lag is the gap between when a payment arrives in your bank account and when you receive the FIRC or can submit the BRC, and it creates a real, if inadvertent, compliance risk.

When payment arrives but the FIRC is delayed, the EDPMS entry stays open even though you have genuinely received the money. This happens when payments are routed through intermediaries, correspondent banks, or payment aggregators that are slow to issue certificates.

From the RBI's monitoring perspective, an open entry looks the same whether the delay comes from documentation lag or deliberate non-reporting. The system flags it either way until you close it. A documentation lag differs from non-compliance in intent, yet it looks identical in EDPMS until you close the entry with the correct documents.

This scenario is particularly common for freelancers and small agencies receiving payments via platforms or non-bank channels. In those cases, the link between the inward remittance and the original export invoice is not automatically established.

The practical risk is a notice. If your AD bank is audited or runs a periodic EDPMS review while your entry is still open because of documentation lag, you may receive one even though no money is missing and you have always intended to comply.

How Can You Prevent EDPMS Non-Compliance as an Exporter?

EDPMS non-compliance is largely preventable if you build a short <a href="https://www.skydo.com/blog/cross-border-tax-compliance">documentation routine</a> around every international payment you receive. The routine has 5 steps: confirm the EDPMS entry exists, request your FIRC, match the remittance to the invoice, submit the BRC, and keep a digital record.

If you handle multiple invoices at once, keep a simple tracker. A spreadsheet is sufficient. List each invoice number, the expected payment date, the FIRC receipt date and the BRC submission date, so no entry silently ages past the deadline.

How Does Skydo Help You Stay EDPMS-Compliant Automatically?

Waiting for a FIRC, chasing the bank for a BRC and manually matching remittances to invoices is the root cause of most EDPMS reconciliation delays. <a href="https://www.skydo.com/">Skydo</a> removes that lag entirely.

What Is EDPMS and Why Do Open Entries Matter?

EDPMS (Export Data Processing and Monitoring System) is an RBI-mandated digital platform that tracks every export transaction from the moment a Shipping Bill is filed at Customs through to realization of payment in your Indian bank account. Open entries matter because an entry stays open, and so does your compliance obligation, until the remittance is matched to its Shipping Bill and the electronic Bank Realisation Certificate (eBRC) is issued.

At its core,<a href="https://www.skydo.com/blog/understanding-edpms-full-form-and-its-essential-role-in-export-management">EDPMS</a> links the inward remittance from your foreign buyer to the specific Shipping Bill filed at Customs. Once the AD bank confirms that match in EDPMS, the data is transmitted to the DGFT portal, which then generates the eBRC.

Say a Bengaluru textile exporter ships goods worth $5,000 to a buyer in Germany. The moment Customs processes the Shipping Bill, an EDPMS entry is created. Until the $5,000 arrives, the Authorised Dealer (AD) bank matches it to that Shipping Bill, and the eBRC is issued, the entry stays open.

Why Do EDPMS Entries Stay Open or Pending?

EDPMS entries stay open or pending for these reasons: delayed or partial payment from the overseas buyer, mismatched invoice values between the Shipping Bill and the remittance received, purpose code errors on the inward remittance that stop the bank's system from auto-matching it to the export, missing or delayed eBRC submission, multiple Shipping Bills being settled against a single remittance (which requires manual linking), and no one internally owning the reconciliation.

Receiving export proceeds does not auto-close an EDPMS entry. The remittance must be matched, and the AD bank must update or close the entry after completing its genuineness check. Money arriving does not mean the entry has closed.

Even after the money has arrived, a purpose code error is often what keeps an entry open.

Ownership is the last gap. Finance teams often assume the bank or the CA is tracking open entries, and the bank assumes you are on top of it. The result is that nobody is, and entries accumulate silently.

Most exporters only discover an entry is stuck when the bank flags it during a routine review, or when an EPCG or RoDTEP claim gets blocked because of the open entry. Unresolved entries compound quietly, so by the time a bank formally raises the issue, you can be looking at months or years of backlog rather than one clean fix.

Timing adds pressure. Entries open within the prescribed period (currently 9 months from the shipment date for most exports) are treated as in-process. Beyond that, the AD bank is required to follow up and may report the entry as overdue. Extended non-realization risks flagging to the RBI caution list, which can block future export transactions and deny export incentives.

What Happens to Open EDPMS Entries When You Switch AD Banks?

When you switch AD banks, your open EDPMS entries do not automatically migrate, close, or transfer. They stay linked to the original Shipping Bill and the AD code registered at the time of export, so opening an account at a new bank gives that bank no visibility into or responsibility for them.

The new AD bank has to be formally registered as the Authorised Dealer for those open Shipping Bill entries before it can act on them. Until that handoff happens, the entries remain the responsibility of the outgoing bank, even if your account there is dormant or closed.

The outgoing and incoming banks must coordinate. The incoming bank picks up responsibility for the open Shipping Bill entries, and a formal internal communication between the banks triggers that handoff, so your word alone is not enough.

This creates a specific risk mid-transition. If you close your old bank account before the open entries have been formally transferred, the new AD bank may refuse to accept responsibility, leaving those entries orphaned in the system and potentially FEMA-flagged.

How Do You Transfer Open EDPMS Entries to Your New AD Bank?

To transfer open EDPMS entries to your new AD bank, you audit every open entry on ICEGATE, obtain a No Objection Certificate (NOC) from the outgoing bank, submit Shipping Bill-wise details to the new bank, confirm the new bank acknowledges responsibility within its own system, and verify on ICEGATE that the entries now reflect the new bank. The steps run in this order.

What Documents Do You Need When Switching AD Banks for EDPMS?

Switching AD banks for EDPMS involves eight documents: the NOC from the outgoing bank, a Shipping Bill-wise list of open EDPMS entries, a copy of each open Shipping Bill, the invoice for each, the IRM or Foreign Inward Remittance Certificate (FIRC) for payments already received but unmatched, an eBRC status confirmation, a written transfer letter from you to both banks, and the AD code registration documents for the new bank. The table shows who needs each one.

What Are the FEMA Compliance Risks During a Bank Switch?

The FEMA compliance risks of an AD bank switch are orphaned entries (entries with no AD bank formally responsible for them), entries reported as overdue because the transition gap pushed them past the prescribed realization period, and potential caution listing if entries stay unresolved for an extended period.

The prescribed period for realization of export proceeds is currently 9 months from the date of shipment for most exports. If a bank-switch transition delays matching or closure and pushes an entry past that window, the AD bank is required to report it as overdue, even if the delay was administrative.

The scenario most likely to result in FEMA non-compliance is a premature account closure. If you close the old account before the entries are formally transferred, no AD bank is responsible for following up on those entries with RBI. The risk comes from that gap. The switch itself is not a FEMA violation, and the violation happens when no AD bank is formally responsible for an open entry.

Prior to October 2026, the RBI maintained a "caution list" for exporters with unrealized payments exceeding 2 years. Under the new FEMA 2026 regulations, this has been replaced by a revised compliance framework. Now, if your export proceeds remain unrealized beyond 1 year, your AD bank may restrict you to exporting only against 100% advance payments or irrevocable Letters of Credit.

Whether you are dealing with a legacy caution list flag or the new 2026 restrictions, persistent open entries even from an administrative bank-switch gap will trigger these consequences:

What Did FEMA Export Regulations 2026 Change for Open EDPMS Entries?

The FEMA Export and Import Regulations 2026, effective 1 October 2026, made three changes relevant to open EDPMS entries, including during a bank transition. They replaced the earlier caution listing mechanism with a revised compliance framework, extended the small-value self-declaration route for closing entries at or below ₹10 lakh, and changed the EDPMS timelines for realizing export proceeds and closing entries.

Entries that were already overdue under the old framework but fall within the new 2026 timeline parameters may have a different compliance status after October 2026. Confirm this with the new AD bank before assuming an entry is flagged.

FEMA 2026 did not eliminate compliance obligations for old open entries. It changed the framework that governs them, so every open entry needs to be reviewed against the new rules, including those created before October 2026.

How Does Skydo Help Exporters Managing an AD Bank Switch?

One of the most time-consuming tasks in an AD bank switch is gathering proof of every inward remittance, meaning FIRC or eBRC-equivalent documentation, to present to the incoming bank for each open Shipping Bill. <a href="https://www.skydo.com/">Skydo</a> is built to take that chase off your plate.

What Are Export Documents Required for Audit?

Export documents required for audit are the set of records an Indian exporter must maintain and present when a regulatory authority (customs, GST, income tax, or RBI/FEMA) examines their export transactions for compliance.

These documents are your evidence that you declared goods or services correctly, charged the right taxes or claimed the right exemptions, received payment in foreign exchange, and met RBI reporting requirements.

Take a Pune-based software exporter invoicing a US client $5,000. If any of the four regulatory frameworks audits that transaction, the exporter must produce the <a href="https://www.skydo.com/blog/what-is-export-invoice">export invoice</a>, a Letter of Undertaking (LUT) under GST, bank remittance records, and a Foreign Inward Remittance Certificate (FIRC) or Bank Inward Remittance Certificate (BIRC). One document is not enough. The full chain is what an auditor asks for.

Which Types of Audits Can an Indian Exporter Face?

An Indian exporter can face four distinct types of audits: a Customs Audit, a GST Audit, an Income Tax Audit and a FEMA/RBI Compliance Review. Each is conducted by a different authority, checks different documents and has its own trigger, so you need to keep the right paperwork for all four.

What Documents Are Required for a Customs Audit?

A customs audit requires you to produce documents showing that the shipment details, declared value and nature of goods match what was actually exported. The core set is the shipping bill, commercial invoice, packing list, Bill of Lading or Airway Bill, and ARE-1 form, and the Customs Audit Regulations, 2018 require you to preserve them for a minimum of 5 years from the date of export.

Missing even one document from this chain can trigger penalties during a customs audit. A shipping bill that does not reconcile with the commercial invoice is one example.

What Documents Do You Need for a GST Audit as an Exporter?

For a GST audit, you need records that prove your exports were made under the <a href="https://www.skydo.com/blog/export-of-services-under-gst">correct GST treatment</a>, either zero-rated with a LUT/Bond or with IGST paid and subsequently refunded. The core documents are your GSTR-1 and GSTR-3B returns, the LUT or Export Bond, export invoices, refund claim records (Form RFD-01) and, for service exporters, a FIRC/BIRC. GST records must be maintained for 6 years from the due date of the annual return for the relevant year.

Which Documents Are Needed for an Income Tax Audit?

An income tax audit for an exporter requires financial records that verify total receipts, allowable deductions and foreign income, filed in the prescribed forms under Section 44AB of the Income Tax Act. The core documents are audited financial statements, Form 3CA/3CB and Form 3CD, books of accounts, foreign remittance records and, if applicable, TDS/TCS records. Books of accounts must be maintained for 8 years from the end of the relevant assessment year.

Section 44AB requires a tax audit if your total gross receipts exceed ₹1 crore in a financial year for business, or ₹50 lakh for professional services. The threshold applies to total receipts, not just export income, so all receipts count toward it. Service exporters should not assume their foreign income is exempt from tax audit scrutiny.

What Proof of Payment Documents Are Required for FEMA Compliance?

For FEMA compliance, you need documents that prove foreign exchange was received in India within the prescribed time period and reported correctly to the authorised dealer bank. The primary proof of payment documents are the FIRC or BIRC, the bank remittance advice or SWIFT confirmation, the purpose code declaration and EDPMS closure proof, and they should be preserved for at least 5 years.

The 5-year retention matters because customs auditors, under the 2018 Regulations, can request payment evidence alongside shipment records.

If you receive international payments through <a href="https://www.skydo.com/">Skydo</a>, a FIRC/BIRC is automatically issued per transaction and stored digitally, so you don't need to chase your bank before an audit.

Pre-Audit Export Document Checklist for Indian Exporters

A pre-audit export document checklist for Indian exporters covers 10 categories of records that must be complete, correctly dated and immediately accessible before an auditor arrives: shipping bills, commercial invoices, packing lists, Bill of Lading or Airway Bill, LUT or Export Bond, GSTR-1 and GSTR-3B returns, FIRC/BIRC, EDPMS closure records, audited financial statements with Form 3CA/3CB and 3CD, and purpose code records.

Run through this list at least 30 days before a scheduled audit or year-end. Gaps in any one category can delay your response to an auditor's notice.

How Does Skydo Help You Stay Audit-Ready for Export Payments?

The payment side of an audit comes down to one question: can you produce a proper FIRC or BIRC for every transaction? FEMA auditors require one per transaction, and a bank statement alone does not satisfy them. Waiting on a bank RM to dig those certificates out right before an audit is the problem Skydo is built to remove.

<a href="https://www.skydo.com/">Skydo</a> helps Indian exporters stay audit-ready for payment-related compliance by automatically generating and storing FIRC/BIRC certificates for every international payment received. Every inward remittance processed through Skydo comes with an auto-generated FIRC/BIRC, issued per transaction and available digitally at any time.

Setup takes 10–15 minutes. Virtual accounts are available in USD, EUR, GBP, SGD, AUD and CAD, all free of cost.

What Is SOFTEX and Why Does the Filing Deadline Matter?

<a href="https://www.skydo.com/blog/softex-form-guide-indian-exporters">SOFTEX</a> is a mandatory export declaration form issued under the Foreign Exchange Management Act (FEMA), 1999. Indian companies and freelancers use it to declare the export of software or IT-enabled services delivered electronically. It is essentially a digital shipping bill for invisible exports, since software leaves no physical trail at customs. The filing deadline matters because SOFTEX is the declaration that tells RBI an export happened.

The form does three jobs. It tracks foreign exchange inflows from software exports, enforces FEMA compliance by making sure exporters repatriate earnings within stipulated deadlines, and certifies export valuations to prevent illegal fund transfers.

Say a Bengaluru SaaS startup invoices a US client $5,000 for a software project delivered over the internet. No goods cross a port, so there is no shipping bill. The SOFTEX form is what tells RBI that the export happened and that the payment must come back within the allowed period.

What Actually Happens If SOFTEX Is Not Filed on Time?

When SOFTEX is not filed on time, the export record stays open in the Export Data Processing and Monitoring System (EDPMS). The AD bank cannot reconcile the inward payment against the invoice or close the record, and the Foreign Inward Remittance Certificate (FIRC) cannot be issued until the record is regularized. The remittance may also be treated as "general services" instead of export proceeds, and banks may impose account restrictions.

EDPMS is the RBI's monitoring backbone. It tracks every export transaction from declaration through payment realization to closure, so a missing SOFTEX leaves the transaction stuck partway.

The open-entry flag is the first consequence, and it isn't an automatic FEMA prosecution. That gives you a window to act before the matter escalates.

What Are the Penalties for Missing the SOFTEX Deadline?

The penalty for missing the SOFTEX deadline falls under Section 13(1) of FEMA, 1999, and can run up to three times the sum involved where that amount is quantifiable. A continuing contravention, where the violation persists day after day, can attract an additional daily penalty on top of the principal penalty.

How Do You Fix a Missed SOFTEX Filing Through Condonation?

You fix a missed SOFTEX filing through condonation of delay. It is a formal process where you approach the certifying authority, explain the reason for the delay, and request that the late filing be accepted and regularized. The authority grants condonation where the delay is for genuine reasons, and it can attach conditions.

The process differs depending on whether you are an STPI unit or a non-STPI (Domestic Tariff Area, or DTA) unit. The comparison table in the next section shows who to approach in each case. The general steps are:

Timelines vary. Condonation cases may take longer depending on the authority's workload.

STPI vs Non-STPI Units: Who Do You Approach for Late Filing?

The authority you approach for a late SOFTEX filing, and for condonation, depends on how your unit is registered. STPI units approach the STPI software exports centre where the unit is registered, and STPI is their certifying authority. Non-STPI (Domestic Tariff Area) units approach their AD Category-1 (AD-1) bank. SEZ units route declarations through the Development Commissioner of the SEZ, not through STPI or the AD bank.

Under the 2026 regulatory framework, AD-1 banks are recognized as a "Specified Authority" on par with STPI. That means DTA software exporters can route their declaration, and a late filing, through their bank directly.

What Happens When SOFTEX Not Filed on Time Goes to RBI?

If an EDPMS entry stays open for an extended period without the exporter taking action, the AD bank is required to report it to RBI. At that point the matter moves from an administrative reconciliation issue to a potential FEMA enforcement matter, and your window to self-correct narrows significantly.

Ignoring an open EDPMS entry is the riskiest option. The escalation path runs from open entry to bank report, then RBI attention, then FEMA enforcement, and it is real and sequential.

The move from SOFTEX to the Export Declaration Form (EDF) doesn't wipe out existing SOFTEX filings or their EDPMS entries. They still need to be reconciled and closed in the normal course, and the AD bank continues monitoring them after the EDF regime takes over in October 2026.

Does the 2026 EDF Transition Cancel Your Pending SOFTEX Obligations?

No. The 2026 EDF transition does not cancel pending or unfiled SOFTEX obligations, and old obligations under the STPI/RBI framework still apply in full. The final notification, FEMA 23(R)/2026-RB, was gazetted on January 13, 2026, with an effective date of October 1, 2026. It replaces 167 existing circulars and supersedes the entire 2015 export framework, but it does not retroactively waive filings due before October 1, 2026.

Existing SOFTEX filings and their open EDPMS entries still need to be reconciled and closed in the normal course. The AD bank continues monitoring these entries even after EDF takes effect.

How Skydo Helps You Stay Ahead of SOFTEX Compliance?

The biggest documentation burden in a late SOFTEX or condonation case is proving that the payment came in. You end up gathering FIRC and FIRA copies, matching amounts to invoices, and showing the bank a clean remittance record. That is where <a href="https://www.skydo.com/">Skydo</a> fits in. It helps Indian software exporters and IT service providers receive international payments with a clean, automatic documentary trail, the kind that makes condonation submissions and compliance checks significantly easier.

If you want your compliance trail always complete, automatically, without scrambling when a bank or regulator asks, Skydo removes the documentation gap that leads to late filing crises in the first place.

What Is Export Realisation and When Does It Become Overdue?

Export realisation is the collection of payment from an overseas buyer for goods or services you've exported, and it is complete only when the funds land in your account. An invoice or a promise to pay doesn't complete it. Your export becomes overdue the moment the prescribed realisation window lapses without the funds reaching your Indian account.

The RBI mandates that you <a href="https://www.skydo.com/blog/realisation-and-repatriation">realise and repatriate</a> the full value of your exports within a prescribed period from the date of export.

Repatriation is the step that follows realisation. You convert the received foreign currency into Indian Rupees through an Authorised Dealer (AD) bank, and the amount is credited to your Indian account.

Take a Bengaluru textile exporter who ships goods worth $15,000 to a US buyer on 1 January. If those funds haven't reached the exporter's Indian account by the end of the applicable realisation window, the export is treated as overdue under FEMA. That holds regardless of whether the buyer claims to have initiated the transfer.

What Happens When Export Payment Is Not Received in 9 Months?

If your export payment doesn't arrive within the prescribed period, you face a FEMA penalty of up to 3 times the value of the export proceeds where the amount is quantifiable (or up to ₹2,00,000 where it is not) plus ₹5,000 for each day the violation continues. You also risk a place on the RBI's Exporters' Caution List, banking restrictions, a stalled GST refund, working capital pressure and the loss of export incentives.

The consequences of <a href="https://www.skydo.com/blog/export-realisation-guide">overdue export realisation</a> span financial, regulatory and banking dimensions, and they escalate the longer the payment remains unrealised.

What Should You Do If Export Realisation Is Already Overdue?

If your export realisation is already overdue, take four steps: contact your AD bank, file for an extension, document all buyer correspondence, and explore a claim with the Export Credit Guarantee Corporation (ECGC) if the buyer is unresponsive.

Notify your AD bank in writing that the <a href="https://www.skydo.com/blog/crystallization-of-export-bills">payment is overdue</a>. Don't wait for the bank to flag it first. Provide the export invoice, the shipping bill, and any communication with the buyer showing the payment is expected but delayed.

Step 2: File for an Extension of the Realisation Period

Step 3: Document All Buyer Correspondence

Compile every email, message or written communication where the buyer acknowledges the debt or commits to a payment date. This is your primary evidence that the delay is genuine and not wilful.

Also check that your invoice, shipping bill and remittance advice are consistent before you submit. A mismatch between them is one of the most common reasons an export entry stays open.

Step 4: Explore an ECGC Claim if the Buyer Is Unresponsive

If the buyer is unresponsive or the payment appears unrecoverable, check whether your export shipment was covered under ECGC insurance. Government programs such as ECGC may offer dispute resolution support or insurance payouts to protect against non-payment.

What Documents Do You Need to Prove Export Realisation Compliance?

To prove export realisation compliance, you need the FIRC, the BRC, shipping bills and matching export invoices. You also submit an <a href="https://www.skydo.com/blog/export-declaration-form">Export Declaration Form (EDF)</a> to your authorised bank within 21 days from the date of export.

Manually tracking payment timelines across buyers is where realisation delays silently build up. <a href="https://www.skydo.com/">Skydo's dashboard</a> shows real-time settlement status and auto-generates a Foreign Inward Remittance Acknowledgement (FIRA), the equivalent of FIRC, so you're never caught off-guard at month 8.

How Can You Apply for an Extension of the Export Realisation Period?

You apply for an extension of the export realisation period by submitting a written request to your AD bank, supported by documents that demonstrate the delay is genuine. AD banks handle most extensions directly without requiring RBI involvement.

For most cases, the request goes to your AD bank and not directly to the RBI. The bank evaluates the merit of the case and either grants the extension or escalates it to RBI, depending on the amount and circumstances.

The extension framework was amended under the Foreign Exchange Management (Export of Goods and Services) (Second Amendment) Regulations, 2025 (FEMA 23(R)/(7)/2025-RB, dated 13 November 2025). The amendment made the extension process more flexible compared to the previous case-by-case basis.

The FEMA Section 13 penalty is calculated from the expiry of the realisation period, not from the export date. An approved extension therefore directly defers the penalty trigger.

Here is a worked example. You ship $10,000 of goods and receive no payment by month 9. You face a potential FEMA penalty of up to 3 times the rupee equivalent (approximately ₹28,50,000 at ₹95/$), plus ₹5,000 per day of continued delay. Filing an extension request before the deadline lapses, or immediately after, is significantly cheaper.

Does 'Buyer Delay' vs 'Banking Failure' Change How RBI Treats Your Case?

A buyer's delay does not pause the RBI clock. FEMA counts realisation from when funds reach your Indian account, regardless of when the buyer initiates the transfer, so you need to file for an extension with your AD bank to avoid penalty accrual.

Whatever the cause of the delay, written buyer correspondence is your primary evidence that the delay is genuine and not wilful. That matters because an AD bank can recommend an exporter to the RBI's Exporters' Caution List if the exporter is unreachable or not making genuine efforts to realise.

How Skydo Helps Prevent Export Realisation Delays Before They Start?

Once your extension is filed and your documents are in order, the longer-term fix is making sure realisation delays don't recur. That starts with the payment infrastructure you use to receive funds.

Skydo is a cross-border payments platform for Indian exporters, built around the points where realisation timelines tend to slip:
